Boppy Newborn Lounger Lawyer

Babies sleep a tremendous amount of the time. While each baby has unique sleeping habits, babies generally sleep 8 hours in the daytime and another 8 hours at night. Also, babies are liable to fall asleep nearly anywhere. Infants may nap in car seats, their caregiver’s arms, and strollers. It is necessary to keep a watchful eye since babies are susceptible to complications while sleeping. However, the Boppy Newborn Lounger may cause babies to suffocate. Boppy Newborn Lounger lawyers are working with families whose infants suffered injury or death from an infant lounger.

Our law firm is currently handling lawsuits on behalf of families whose babies were harmed by the Boppy Newborn Lounger. Although an enticing device for infants to sleep in, these pillow-like baby products are not safe. No one should suffer the injury or loss of a child. Even though a lawsuit cannot rectify the damage inflicted by Boppy products, our lawyers can assist you in holding the Boppy Company accountable.

What is the Boppy Newborn Lounger?

The Boppy Company manufactures a wide selection of infant pillows, baby carriers, and nursing pillows. The baby company introduced its Boppy Newborn Lounger in January 2004. Many retailers such as Amazon, Target, and Walmart distributed the product across the United States and Canada. The Boppy Newborn Lounger is a pillow-like product designed with a gentle incline to cradle a baby while it plays or rests. Boppy marketed the Newborn Lounger as a comfy device to situate a baby if a caretaker needs to take a break from holding the baby. The product has higher edges to prop the baby up so it can play with toys.

Boppy Newborn Lounger Recall

With the product’s soft cushions that comfortably support babies, the Boppy Newborn Lounger seems like an ideal spot for many infants to sleep. However, the Boppy Newborn Lounger puts infants at risk of positional asphyxia. Babies are susceptible to falling asleep or rolling over into a position that obstructs their breathing. After eight reported suffocation deaths, the Boppy Company finally recalled the Boppy Newborn Lounger in 2021. The recall affected roughly 3.3 million units and applied to Boppy Original Newborn Loungers, Boppy Preferred Newborn Loungers, and Pottery Barn Kids Boppy Newborn Loungers.

More Deaths Linked to Boppy Newborn Lounger

In June 2023, the Consumer Product Safety Commission (CPSC) reported two more deaths potentially linked to the Boppy Newborn Lounger after the September 2021 recall.

Boppy Newborn Lounger Lawsuits

Boppy stated that it did not market the pillow as an infant sleep product. Although, lawsuits allege the company should have understood the soft plush device made an attractive sleeping environment for infants. Furthermore, plaintiffs argue that Boppy failed to change the design even though the first infant death was reported in 2015. Instead, the company allowed the Boppy Newborn Lounger to remain on the market for six more years.

Do I Qualify for a Boppy Newborn Lounger Lawsuit?

If your baby suffered injury or death while using a Boppy Newborn Lounger, you may qualify for a lawsuit against the Boppy Company. A Boppy Newborn Lounger lawyer can help you recover compensation for:

  • Past and future medical expenses;
  • Past and future pain and suffering;
  • Loss of wages; and
  • Other economic losses related to your injury

The Consumer Product Safety Commission chairman announced that even infant products not designated for sleep are too risky. The Boppy Company should have considered that babies frequently fall asleep and can succumb to suffocation very quickly. Boppy Newborn Loungers’ incline and overstuffed edges put babies in compromising positions that prevented them from lying flat. After the first reported death in 2015, Boppy should have taken steps to modify or recall its Newborn Lounger.
