Zinus Mattress Lawsuit Lawyer

We spend approximately one-third of our lives sleeping or attempting to do so. Sleep is a critical state that ensures the proper functioning of both mind and body. Therefore, people want to invest in a mattress that will allow them a restful and relaxing full night’s sleep. However, the Zinus mattress may actually harm sleepers rather than lull them to sleep. Did your Zinus mattress injure you? Reach out today to learn more about how a Zinus mattress lawsuit can benefit you.

Our law firm is currently handling lawsuits on behalf of individuals exposed to hazardous glass fibers released by Zinus, Inc.’s mattresses. Exposure to glass fibers from Zinus mattresses can increase the risk of serious and potentially life-threatening injuries.

What is the Zinus Mattress?

Zinus has offered mattresses and furniture for over 25 to more than 15 countries. On its website, the company claims to provide affordable and easy-to-assemble products to brighten one’s home. Consumers can purchase sofas, bed frames, tables, outdoor furniture, and of course, mattresses from Zinus. These mattresses are available in various sizes and in either memory foam or hybrid styles for the sleeper’s support needs. Zinus infuses its sustainable mattresses with green tea, olive oil, and charcoal to provide relaxation for consumers. In addition to these natural components, the company also manufactures its mattresses with fiberglass as a fire retardant.

Fiberglass Problems With Zinus Mattresses

Fiberglass consists of glass and reinforced plastic. While commonly used in wall insulation, mattress manufacturers also use fiberglass for fire-retardant purposes. Fiberglass is an ideal material for mattresses since it is malleable and durable. Also, it is cost-effective because it is cheap to mass produce. Mattresses are highly flammable, but fiberglass inhibits the mattress from bursting into flames. If a mattress were to catch on fire, the fiberglass would cause the mattress to melt instead. Manufacturers need to ensure that the fiberglass remains within the mattress so that consumers avoid direct contact with the material. Zinus mattresses have fiberglass, but the zippered outer cover is supposed to keep the fiberglass within.

However, lawsuits allege that Zinus labels did not originally advise consumers not to remove the outer cover. When someone removes the outer cover of a Zinus mattress, this can release thousands of tiny shards of fiberglass.

Zinus Mattress Injuries

Exposure to fiberglass can result in serious injuries including:

  • Dermatitis
  • Chronic breathing issues
  • Upper respiratory infections
  • Eye damage
  • Gastrointestinal problems
  • Worsening of asthma symptoms

Individuals who have been injured by defective Zinus mattresses may also require surgery. If fiberglass becomes deeply embedded in the skin this can result in infections.

What Do We Know About Zinus Mattress Lawsuits?

Approximately 8,000 people in the United States own defective Zinus mattresses. Zinus mattresses contain a zipper on the outer cover, suggesting to users that it is removable. However, when the consumer removes the outer layer, the inner layer releases fiberglass. Glass fragments get stuck under the skin and may require surgery to remove them. Additionally, fiberglass shards are nearly impossible to remove without the help of a professional. Homes contaminated with fiberglass may require a fiberglass removal service to properly clear the home of the hazardous material.

The U.S. Consumer Product Safety Commission (CPSC) has received more than a dozen complaints related to fiberglass in mattresses. A class action lawsuit has been filed against Zinus for failing to adequately warn consumers about this defect and fraudulently concealing the health hazards associated with its mattresses.

In February 2020, Amanda Chandler and Robert Durham of Illinois filed a class action lawsuit against Zinus and its retailers claiming that the mattress was defective. The couple discovered tiny pieces of fiberglass on their child’s bed and clothing. The tiny fragments caused cuts on his skin and destroyed many of the family’s personal belongings. Other retailers who sold the mattresses, including Target Corp., Amazon, LLC, and Walmart, were added as defendants to the lawsuit. The number of plaintiffs in the class action against Zinus has grown to nearly 200.

Also, in August 2022, women in Sacramento proposed another class-action lawsuit against Zinus. The plaintiff claims that the mattress caused severe health complications in her family of five and cost her $20,000 in damages. This lawsuit is still awaiting class certification.

Liability Law and Zinus Mattress

  • Lawsuits against Zinus allege that its mattresses are defective and impose an unreasonable risk of harm to consumers.
  • Consumers who bought Zinus mattresses claim that the instructions did not inform them that the outer cover should not be removed or that removal of the outer cover could expose users to glass fibers in the mattress.

Can I Recover Compensation for My Injuries in a Zinus Mattress Lawsuit?

If you or a loved one has been injured by Zinus Mattress, you may recover compensation for any or all of the following:

  • Past and future medical expenses;
  • Past and future pain and suffering;
  • Loss of wages; and
  • Other economic losses related to your injury.

The Zinus label states it contains 62% fiberglass, but does not explicitly warn customers about removing the outer cover. Lawsuits argue that the presence of the zipper implies to the public that it can be safely removed. Not only can exposed fiberglass result in thousands of dollars of household damage, but it can also cause several adverse health complications in children and adults.
