Jury Orders Bayer to Pay $332 Million in Roundup Cancer Trial

In yet another significant milestone in Roundup lawsuits, a California jury recently delivered a verdict that has caught the attention of many. The verdict held Bayer, the company behind Roundup weed killer, liable for a case brought by a man named Mike Dennis. Dennis claimed that his cancer was a result of exposure to Roundup, and the jury ordered Bayer to pay a total of $332 million in the Roundup cancer trial. In favorable news for plaintiffs, this marks the third loss for Bayer during October.  

The Case That Cost Bayer $332 Million in Roundup Cancer Trial 

Mike Dennis filed a claim against Bayer, claiming that his use of this widely used herbicide was the root cause of his cancer. He was diagnosed with non-Hodgkin lymphoma at the age of 51. Dennis joined thousands of other Roundup plaintiffs, alleging that exposure to Roundup was a contributing factor to his cancer diagnosis.  

A California jury handed down a verdict in favor of Dennis on October 31, 2023, ordering Bayer to pay $332 million. The hefty verdict includes both compensatory and punitive damages. The jury granted Dennis $7 million in compensatory damages to compensate him for losses he suffered due to his cancer. In addition to the compensatory damages, the jury imposed a whopping $325 million in punitive damages on Bayer. These punitive damages are designed to make an example of Bayer and discourage other companies from doing the same.   

The jury found Bayer liable for two out of the four legal claims presented. The jury held Bayer responsible for not warning users about the risks associated with Roundup. However, the jury did not find the company negligent, determining that the company did not defectively design the product.

 In response to the verdict, Bayer has stated its intention to appeal. The company argues that legal and evidentiary errors impacted the trial. Bayer hopes to have the verdict overturned and the punitive damage award either eliminated or substantially reduced. 

Ongoing Roundup Lawsuits Against Bayer  

In addition to the recent $332 million verdict, Bayer faced two other verdicts earlier this month: one for $175 million and another for $1.25 million in separate Roundup trials.  

Notably, in 2020, Bayer settled a significant portion of Roundup claims against it. Overall, the company agreed to pay up to $10.9 billion to resolve these cases. While this settlement was a substantial step towards resolving many legal challenges, Bayer still faces a considerable number of Roundup lawsuits, with close to 40,000 cases remaining.
