Paraquat Lawsuit Lawyer

Our law firm is currently handling lawsuits on behalf of individuals who were exposed to the herbicide paraquat and suffered lifelong injury or death. Lawsuits against the manufacturers of paraquat claim that exposure to Paraquat may lead to Parkinson’s Disease.

What Do We Know About Paraquat Lawsuits?

Paraquat is a popular weed killer applied to corn, soybean, and cotton fields. It is manufactured by Syngenta, Growmark, and Chevron U.S.A., Inc.  Many countries have banned the use of Paraquat due to its high levels of toxicity. However, Paraquat is legal and has been gaining popularity in the United States.

Numerous studies have shown that agricultural workers and farmers have an increased risk of developing Parkinson’s Disease after prolonged contact with paraquat. The United Parkinson’s Advocacy Council found evidence that prolonged exposure to paraquat can increase the risk of Parkinson’s Diseases by 200-600%.

Several lawsuits against the manufacturers of Paraquat have been filed. Since February 2021, more than 400 new complaints have been filed in federal courts. In June, a federal court panel consolidated these cases in Illinois, where a large population of farmers have been exposed to Paraquat. Lawsuits are also being filed in California and Illinois state courts as well. Attorneys believe that there may be as many as 35,000 cases against Paraquat manufacturers. Unlike Roundup, which has been the subject of extensive litigation, Paraquat is known as a likely carcinogen, which gives evidentiary weight to the claims against paraquat manufacturers.

Paraquat Injuries

Lawsuits against Paraquat allege that there is a significant link between the toxic herbicide and Parkinson’s Disease. Parkinson’s Disease is a neurodegenerative condition in which nerve cells located in the brain fail to generate enough dopamine. Lack of dopamine can result in tremors, rigidity, and balance problems. Parkinson’s Disease also creates non-physical symptoms such as cognitive decline and depression. Most of these symptoms worsen over time and cause permanent disability and death.

Can I Recover Compensation for My Injuries in a Paraquat Lawsuit?

If you or a loved one has been injured by Paraquat, you may recover compensation for any or all of the following:

  • Past and future medical expenses;
  • Past and future pain and suffering;
  • Loss of wages; and
  • Other economic losses related to your injury.

Studies Linking Paraquat and Parkinson’s Disease

Numerous medical studies have verified a link between Paraquat and Parkinson’s Disease.

The American Journal of Epidemiology studied animal and cell models that indicated that pesticides trigger a neurodegenerative process that cause Parkinson’s Disease. Exposure to pesticides within 500 miles of the subject’s home increased the risk of Parkinson’s Disease by 75%.

The Journal of the American Medical Association concluded that the risk of Parkinson’s Disease rose with pesticide use in certain agricultural related occupations, thus supporting a toxin-linked theory of Parkinson’s Disease.

New research conducted by the National Institutes of Health found that people who used Paraquat developed the neurodegenerative condition approximately 2.5 times more often than non-exposed individuals.

Liability Law and Paraquat

  • The companies who manufacture Paraquat have known that the chemical is toxic and could cause Parkinson’s Disease.
  • Despite having knowledge that paraquat is linked to Parkinson’s Disease, manufacturers have continued to market and sell the product.
  • Manufacturers of Paraquat did not adequately warn consumers about the risks of the herbicide.
