Next Bard Hernia Mesh Trials Scheduled for Oct. 2023 and Apr. 2024

With over 20,000 product liability cases and a myriad of injuries linked to various hernia mesh products, these lawsuits have garnered significant attention. Now, the judge overseeing federal hernia mesh lawsuits has scheduled two hernia mesh trials for October 2023 and April 2024. These bellwether trials hold immense significance as they shed light on how juries may respond to crucial evidence and testimony. Overall, the upcoming trials will give us a glimpse into what a Bard hernia mesh settlement could amount to.

Status of Bard Hernia Mesh Lawsuits September 2023

Currently, the landscape of Bard hernia mesh lawsuits is marked by a staggering number of cases, with more than 20,000 claims filed against the manufacturer. These cases are rooted in dangerous complications allegedly linked to a range of Bard hernia mesh products, including:

  • Bard Ventralight
  • Bard Ventrale
  • Bard 3DMax
  • Bard PerFix Plug

These complications include several health issues reported by patients who underwent hernia repair procedures. Unfortunately, patients report suffering from chronic pain, internal bleeding, fever, infection, and fistula injuries. Oftentimes, these injuries are so bad that patients resort to painful and costly revision surgery.

Hernia mesh lawsuits have been centralized before U.S. District Judge Edmund A. Sargus in the Southern District of Ohio. This process, known as multidistrict litigation (MDL), streamlines the litigation process by consolidating similar cases under a single judge to ensure consistency and efficiency.

The Outcome of Previous Bard Hernia Mesh Trials

Looking back at the first two Bard hernia mesh trials held in August 2021 and April 2022 will help us understand the significance of future trials. In the initial trial, which took place in August 2021, Bard emerged victorious with a defense verdict. Therefore, the jury did not find Bard liable for the injuries alleged by the plaintiff.

However, the tides shifted in the second bellwether case in April 2022, resulting in a verdict of $255,000 awarded to the plaintiff. This marked the first significant victory for a plaintiff in the Bard hernia mesh lawsuits.

The mixed results from the first two trials added complexity to the negotiation table. While Bard tasted victory once, they also faced a substantial payout. This intricate mix of wins and losses impacted the willingness of both sides to reach a Bard hernia mesh settlement.

Furthermore, like many sectors, the legal world faced significant disruptions due to the pandemic. It led to delays in court proceedings, including the Bard hernia mesh litigation. These delays meant that many claimants had to endure prolonged periods of uncertainty while waiting for their day in court.

Judge Announces Dates for Bard Hernia Mesh Trials

Now, let’s turn our attention to what lies ahead on this legal journey: the third and fourth Bard hernia mesh trials. The third bellwether trial, slated for October 2023, spotlights a lawsuit filed by Robert Stinson, Jr. In this case, Stinson’s case involves the Bard PerFix Plug. Following closely, the fourth bellwether trial, scheduled for April 2024, centers around a lawsuit brought by Jacob Bryan. His case pertains to the Bard 3DMax.

One crucial detail to note is the requirement for the parties involved to resolve issues related to the plaintiffs’ interrogatories within seven days. This means that both sides must work swiftly to address key questions and requests for information posed by the plaintiffs. This step is essential in ensuring a fair and thorough examination of the facts in these lawsuits.
